I think that a negotiated union contract would ideally have clauses related to overtime modeled on factory/shop floor rules: overtime is possible, but it has limits, it requires specific remuneration, etc.
Like shops, devs have can have surprising workloads and they need to push through them. There’s probably 2 major causes we see:
a) Whoops, your game is a hit and a live game so you need to capitalize
b) Whoops, we weren’t quite sure what we were making so we need to either delay or pile work up to hit an earlier date
b is common and partly because it doesn’t have a cost to the account commensurate to the cost to the employees – most people don’t get paid overtime. If we more tightly constrained schedule slips to cost increases, definitively removing the ‘spend morale/evil points for production’ fuzzy temptation, we’d see much clearer choices between overtime (costs more), slipping the due date (costs more), or locking down and cutting features (game is worse).
I don’t think you’d see the end of crunch, and I’m arguing that it’s sometimes necessary, but it should be used for much better reasons, and it should always be compensated.

Sure, and you could make all these cogent arguments during a negotiation with management without fear of retaliation and with real power and leverage to advocate your position if you were in… a union.
(We are not talking at cross purposes. This is mutual bolstering.)
Yeah, none of this happens without that step. I’m way more hopeful of it now than I was a few years ago; people have positive steps to take, and young professionals are rather open to unions in a way I couldn’t imagine a decade ago.

Salaried employees almost never get overtime in the US regardless of profession (referred to as ‘exempt’); hourly employees get paid by the hour (of course) and labor law usually mandates 1.5x normal pay over forty hours in a week (federal law sets a baseline and state law can improve but not lower it).
Do we really need to beat that particular strawman again?!?

…and what this translates to is that a lot of US companies will just make people salaried when they expect them to work overtime a lot to avoid paying them for it.
