they can’t legally deny used sales in the States as it’s a part of first-sale doctrine (though EULAs are written to specify that the software is being licensed and not sold and therefore first-sale doctrine wouldn’t apply, though I bet you can argue that since the license is, with a physical copy, invariably tied up with said physical copy, your rights persist)

there is an exception for software rental but said exception specifically includes language allowing limited-use computers (e.g. video game consoles) to have their software rented

Nintendo’s plan of attack was to claim that instruction manuals being reproduced or included was a violation of their copyrights, which led to the “Blockbuster lists all the controls on the back of the rental box” kind of stuff

copyright law is fun

EULA have traditionally been denied as legally valid by the courts, IIRC.

That’s one reason so many things have accounts now, so that shit is more theoretically enforceable.

Nintendo managed to outlaw renting games in Japan and really really tried to make reselling them illegal. If they could have sold them divx style they would have.

there’s still some kind of special license required of shops that sell preowned games in japan, isn’t there?

also reggie probably doesnt care what nintendo thinks about anything, used or new, now that he doesnt work for them anymore
